Importance of a Sales Contract When Purchasing a Dog
When they are looking to buy a dog, many future pet owners do not consider a contract. A contract of sale will help you avoid many problems if there are any issues after the purchase. Find out what you should include.
In the excitement of getting a new pet, you may forget about many things. You should not let the purchase contract slip under the table, no matter how much you anticipate it or how sympathetic the breeder is.
A contract of purchase for a living being: a strange fact, but an important one
A contract of sale must be signed when you buy a puppy from a breeder. This document’s factual language may offend dog lovers, but it is required by law to treat the purchase of four-legged friends as if they were a tangible item. The contract mentions “defects”, “intended usage” but one would never talk so coldly about a new family member.
Breeders will have ready-made purchase contracts that you can fill out. On the Internet, you can find many sample contracts – particularly on the breed club websites.
Checklist
Some data should be always included in the contract for sale of the dog:
Breed* Color* Other characteristics* Chip Number* Neutered? Yes/No* Name of parents
Defects and right of withdrawal
A veterinary examination will document the health of your pet if it is sick before you buy him. The breeder also agrees to provide the animal “unadulterated” – without any medication. You accept, in return, that the dog can develop new defects throughout its lifetime.
The right to withdraw from the contract is also important. It guarantees that the dog will be treated in a species-appropriate manner. If you lie, this clause will come into effect. The right to transfer your dog expires only three years after it is transferred. Until then, you must return it if there are any violations. You can also visit the dog for a control in two weeks following your purchase.
Breeders always have the right to first refusal if you wish to give away the dog. Breeders must normally agree to the sale of a dog to another party in advance.
Documents of security & other documents
A contract of sale for a serious breeder is an everyday occurrence. You will receive the contract of sale, as well as the vaccination passport completed, the animal passport, and a certificate certifying the acceptance by the breed warden. If a breeder wants to transfer the litter without any documents, then you should not buy.
A contract of sale can be a good idea even if the animal you are buying does not originate from the breeder. You will be able to take legal action if there are any disputes. When you buy a puppy, hundreds of euro are often exchanged. Is it worth a few minutes of work to sign the contract?
